OVERALL CODE REVIEW COMMISSION MEETING

Chairman declared quorum present.
Approve Minutes of the September 10, 2020 meeting
Member Swanson moved to approve the minutes, seconded by Member Benedict.
Minutes were approved by voice vote.
Update Past Overall Code Review Commission items.
• Variance request of Section 1016 of the 2012 International Fire Code and 2012 International
Building Code to allow the increase in the exit egress distance required by table 1016.2, located at
1801 Monmouth Blvd.was passed.
• Variance request of section 1008.1.5 and section 1008.1.6 Landings at doors. Request to reduce
landing size at rear door from required 44” length to 30”inches,located at 240 E. Simmons St. was
passed.
OC-20-1201 Public Hearing Variance request of Section 602, table 602 of the 2012
International Building Code, Fire resistance ratings
requirements for exterior walls based on separation distance.
Request is to allow a reduction of the 1hr fire rating at 10’ due
to distance, located at 1172 Monroe St.
Jeff Craft (contractor), Mike Tolle and Dan Levi (architectural firm) were present on behalf of the business
via video.
The property is located at 1172 Monroe Street. The owner is proposing to perform a complete renovation
that will include removing almost all the interior walls and the roof and reconstructing the structure for
the Knox Family Dental offices.
Section 602 and table 602 of the 2012 International Building Code requires that an exterior wall of a
building that is > 5 to 10 feet from property lines have a 1 hour fire rating. The existing north exterior wall
of the structure is approximately 9 foot 8 inches away from the north property line. The petitioner is
requesting a variance of the required 1 hour fire rating on the basis that it is only inches from the
requirement, and the additional work and changes to the existing wall to make it conform is going to add
extensive cost.
A motion was made by Member Benbow and a second from Member Benedict to approve the variance.

Chairperson declared the motion approved.
There being no further business Member Swanson made a motion to adjourn, seconded by Member

SUBJECT: OC-22-0201
The property is located at 95 N Seminary St. The owner is proposing to be Grandfathered in from
complying with the 2012 IBC Section 705 Table 705.8, which states that buildings that are within 0’ to 3’
from the property line are not allowed to have any openings.
Currently 17.5% of the South wall has openings and would be Grandfathered in if the windows are not
replaced.
The current set back is 1’8” from the property line. If a 3.5’ no build easement was granted it would create
a total setback of 5’1” from the building wall.
They are also asking for a variance for future construction phases to be considered as having a 5’ to 10’
Fire Separation Distance from adjacent properties. The future building is anticipated to have a change in
occupancy from B to A3, and to be protected by a fully automatic sprinkler. This would allow them to
have 25% of the south wall be window openings per table 705.8.
A copy of the table from the code section that the petitioner is requesting a variance of is attached for your
review.

SUBJECT: OC-22-0202
The property is located at 1611 Grand Ave. The owner has constructed wood framed walls to section off
a portion of the space for gaming purposes. Electrical work has already been ran through out the walls.
Section 602 and table 601 of the 2012 International Building Code does not allow for wood studs in a type
I or type II building. The petitioner is requesting a variance that would allow the use of the existing wood
studs. They propose the use of Painted Pine Siding with a Class C Flame Spread to be placed on the 2x4
framing. See attached drawing below.
