OVERALL CODE REVIEW COMMISSION MEETING
ERICKSON CONFRENCE ROOM
Thursday, February 8, 2024 at 5:30 p.m.
MEMBERS PRESENT: Brian Benbow, Dale Sugden, Jay Feely, Mike Groom, Jeremy Schultz,
Ken Swanson, Rob Benedict, 7
MEMBERS ABSENT : Cody Basham, 1
OTHERS PRESENT: Eric Heiden (Code compliance Supervisor), Rory Speidel (Building
Inspector), Randy Hovind (Fire Chief) , Doug Peterson (Werner
Restoration), Dave West (Harley's Pub), Ryan Litton (Harleys Pub)
Chairmen Benbow called the meeting to order at 530 P.M.
Chairmen Benbow took Roll Call, Declared quorum present.
Approve Minutes of the December 8, 2022 meeting
Member Swanson moved to approve the minutes, seconded by Member
Benedict
Minutes were approved by voice vote.

OC-24-0201 Variance Request of section 903.2.1.2{2) of the 2021 International Building
Code in regards to sprinkler requirements.
Member Benedict questioned if this was the same code that required him to install a sprinkler
system in his outdoor patio at the Vault.
Fire Chief Hovind stated that that was a change of use . Harleys Pub has been an assembly use
since the SO's . Building Inspector Speidel said the addition of the fire walls creating 3 separate
spaces reduced the risk of extensive damage .
Member Schultz asked if it was a good look to grant a sprinkler variance for a building that just
caught fire.
Chief Hovind offered ifthe fire walls had been in place at the time of the fire the damage would
have been contained to the boiler area and would not of spread to the rest of the building.
Chairmen Benbow asked about egress requirements and Chief Hovind stated egress was not an
issue due to the two sets of double exterior doors in the banquet room.
Member Bened ic t stated that we would not grant the variance for the warming shelters for 14
people. He asked if this issue could be tabled . Secretary Heiden stated that the matter should
be voted on at that time to allow an appeal to go to Council.
Doug Peterson stated that there are water damage risks with installing sprinklers and there are
several buildings in Galesburg that are un -sprinkled .
Chief Hovind stated that had the building not been gutted then sprinklers would not have been
requ i red .
Member Sugden mentioned that some insurance companies won 't insure a building that
received a variance .
Member Schultz made a motion to deny the variance and was seconded my Member Benedict .

Being no further bus i ness Member Swanson made a motion seconded by Member Benedict to
adjourn. The meeting adjourned at 5:55 pm .

SUBJECT: OC-24-0501
The property is located at 1475 N Henderson St. They are requesting a variance to the 2021
International Building Code Section 1809.5.
The owner of the property has plans to start a rental storage business at this location. Some of the
concrete pads have been poured in advance. The plans submitted show a 260 foot by 40 foot
building. The International Building code requires frost footings for any building over 600 square
feet. The applicant is requesting the variance due to the amount of remaining footings in place
from the previous hotel on the site. The applicant states that this would be a hardship due to the
financial cost of removing the old footings.
A copy of the code section that the petitioner is requesting a variance of is attached for your review.
