MEMBERS ABSENT: Roger Carlson, Kyle Kelley, Leigh Nygard, 3. OTHERS PRESENT: Stephen Gugliotta AICP, Brad Nolden - City Attorney/Administrative Services Director and Wayne Carl - Director of Planning & Public Works. Chairman declared quorum present. Approve Minutes of the October 22, 2019 meeting Member Johnson moved to approve the minutes, seconded by Member Thomas. Minutes were approved by voice vote. Update Past Planning and Zoning Commission items • Special use application to request the property be used for product assembly, warehouse and storage, located at 888 South Lake Storey Road. P.I.N. 95-33-427-001.Construction drawings were submitted this week for the project. • Zoning map amendment to go from I, Institutional to M1, Light Industrial, located at 340 South Kellogg Street. The City Council approved this zoning amendment at their November 18th meeting. • Minor Plat of the North Prairie Subdivision No 2. The City Council approved this Minor Plat at their November 4th meeting and the subdivision plat was recorded with the Knox County Recorder on November 8th. Receive Citizen Comment None Received. PZ-19-1001 Public Hearing Special use application to request the property be used for a Bar/Tavern, located at 162 West Main Street, P.I.N.99-15-201- 004. Petitioner, Kris Woods and his business partner Dave Kimball were present. The Commission heard from business owners in the area and a relative of someone who lives in the area. They provided a petition with approximately 144 signatures against the special use request. Comments included concerns about safety due to patrons frequently standing in front of the business at their current location, who can be seen holding alcoholic beverages and fights that occur at times. It was stated this causes those who live or shop in the area to not want to walk down the sidewalk and if the business relocates that this will continue at the new location and disrupt existing businesses and nearby residents. There was also concern on how it may affect occupants of the assisted living facility in the block. References to costs and time to property owners having to fix damage done by inebriated individuals to fences, windows, sleeping in trailers, use of guns, etc. General concern that there are already two bars in the block and a convenience store selling alcohol. One individual also mentioned a person was seen on video surveillance walking down a street and pulling out a weapon and firing it at or near an existing bar west of the proposed location. Page 2 of 2 The business owners provided 2 letters of support, one of which was from their current landlord. Mr. Kimball stated he has owned and operated bars in Galesburg in the past with no issues. The owners stated every morning they are outside cleaning up not only their area, but up and down the block. They mentioned at their current location they use security cameras, have police do walk-throughs of the bar at times and use a door man on the weekends to check ID’s, which they would continue to do at the new location. They mentioned the reason patrons stand in front of their current business is because that is the only location they can smoke since the parking lot in back is privately owned. The proposed new location does have area behind the building so there would not be a need to congregate in front. It was mentioned while they do not have specifics yet because this in in the early stages, they plan on fixing the façade, purchasing new equipment, replacing boarded windows and fixing the existing fence. Member McKelvie asked staff what they consider in their Development Review Committee. Staff noted the DRC considers the same criteria the P&Z reviews. Director Carl further noted the DRC recommendation is done so prior to receiving public comment at a public hearing, so in that respect the P&Z would have additional information the DRC does not have at the time of their decision. Attorney Nolden noted the Commission received a petition and letters of support and will be entered as a part of the record. The Commission members considered the following items: • The establishment, maintenance or operation of the special use may be detrimental to or endanger the public health, safety, morals, comfort or general welfare; • The establishment of the special use may impede the normal and orderly development and improvement of surrounding property for uses permitted in the district; and • The Development Review Committee reviewed the proposed variance at their November 6, 2019 meeting and recommend approval. Member Johnson moved, seconded by Member McKelvie to deny the special use. Roll Call #1 Ayes: Davis, Johnson, McKelvie, Thomas, Uhlmann, 5. Nays: None. Abstentions: None. Chairperson declared the motion approved. The property is located at 2791 Veterans Drive. P.I.N: 95-35-326-001. The property owner is requesting a variance of Section 152.033(E) to allow the installation of a fence at 14 feet in height instead of the allowed height of 8 feet. Menards did receive a variance back in 2008 for the existing 14 foot fence that surrounds their material yard, this variance is for a smaller area near the vehicular entrance. Menards, Inc is in the process of adding another lane to the yard gate at the store location. The additional lane will allow for an automated express entrance lane for guests with onine orders. The 14 foot fence is required to insure security of products in the yard, used to block the noise, light and view of the storage from the outside. The property is located in a Commercial (B2) zoning district. The Development Review Committee members reviewed variance request at their February 5, 2020, meeting. (1) The Planning and Zoning Commission shall not vary the provisions of this chapter as authorized in this section unless it shall have made affirmative findings based upon the evidence presented to it in each of the following specific cases: (a) That the property in question cannot yield a reasonable return if permitted to be used only under the conditions allowed by the regulations governing the district in which it is located. Applicants must submit evidence identifying the price paid for the property. Paying more for the property than it is worth, purchasing it at a price which anticipates and obtains variances, or showing that the property would be worth more if a variance is granted is not evidence of lack of a reasonable return; (b) That the situation of the owner is due to unique physical circumstances of the property; and (c) That the variance, if granted, will not alter the essential character of the neighborhood. (2) For the purpose of supplementing the above standards, the Planning and Zoning Commission, in making this determination whenever there are practical difficulties or particular hardships, shall also take into consideration the extent to which the following facts, favorable to the applicant, have been established by the evidence: (a) That the particular physical surroundings, shape or topographical conditions of the specific property involved would bring a particular hardship upon the owner as distinguished from a mere inconvenience if the strict letter of the regulation were to be carried out; (b) That the conditions upon which the petition for variance is based would not be applicable generally to other property within the same zoning classification; (c) That the purpose of the variance is not based exclusively upon a desire to make more money out of the property; (d) That the alleged difficulty or hardship has not been created by any person presently having an interest in the property; (e) That the granting of the variance will not be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located; and (f) That the proposed variance will not impair an adequate supply of light and air to adjacent property, substantially increase the danger of fire, otherwise endanger the public safety, or substantially diminish or impair property values within the neighborhood. (3) The Planning and Zoning Commission may require conditions and restrictions upon the premises benefited by a variance as may be necessary to comply with the standards set forth in this division (C) to reduce or minimize the injurious effect of the variance upon other property in the neighborhood, and to implement the general purpose and intent of this chapter. cc: File Copy 2791 Veterans Dr Menards is in the process of adding another lane to the yard gate at all store locations . The additional lane will allow for an automated express entrance lane for guests with online orders. Guests with an online order can scan a barcode at this gate and go pick up their materials without waiting for the gate guard to let them in . The expansion at the Galesburg store will be to the west of the exist i ng gate . The proposed addition will become the exit lane . The middle entrance lane will be controlled by the gate guard and the lane closest to the store building will become the new order pickup lane . The materials used on the expansion will be a match the green steel and white steel roof on the existing gate . The 14 foot tall wood fence on the exterior will also be a match the existing 14 foot tall fence around the entire Menards yard. This variance is being requested so the new fence can match the existing fence. As Me nards is adding the additional lane to the yard gate at all stores across the country and there is no reasonable alternative to adding on to this gate without requesting the variance and online shopping is a large part of retail business today it is safe to say the property could not yield a reasonable r eturn over the long term . The proposed fence addition will be 14 feet tall for several reasons . First security, Menards stores a lot of products in the yard and those need to be safe and secure . The fence also blocks the noise, light, and view of the storage from the outside. Lastly, the fence will match the existing fence that has existed at this site since the store opened in 2008 . The property owner is requesting annexation in order to receive city water for their business. The parcel is approximately 5.125 acres. • The property is currently contiguous to the City of Galesburg. • There are no electors on this property. This means there are no occupants living on the property that can vote, which means the annexation can proceed without regard to election dates. • It is not located within a floodplain. • It is located within the Galesburg Sanitary District boundaries. • The property is currently zoned M, Restricted Industrial in the County. By city ordinance, when a property is annexed it comes in as the zoning district which most closely corresponds to the county zoning unless otherwise established in a pre-annexation ordinance. In this case, they have an existing concrete company they want to continue to operate and those types of uses are listed as a special use within the M2, Heavy Industrial zoning district. It is for that reason a pre-annexation agreement will be necessary to bring the property in as an M2, Heavy Industrial zoning district. • Even though the pre-annexation agreement will bring the property in as M2, the manufacture of cement & grinding, crushing, processing of minerals and earths will still require they request Special Use approval through the Development Review Committee and Planning & Zoning Commission at a later date. • Adjacent Right-of-Way along Grand Ave and Fifth St will be annexed as a part of the process. The Development Review Committee members reviewed variance request at their November 6, 2019 and February 5, 2020 meetings. The Committee members recommended approval of the pre- annexation agreement. The P&Z has the responsibility of reviewing and making a recommendation to the City Council regarding the proposed zoning of the site to be annexed. The Commission can also provide suggestions to the City Council regarding any needed revisions to the other requirements in the preannexation agreement. Supporting Documents: 1. Box 1387 Galesburg, IL 61401 Page 2 of 9 PREANNEXATION AGREEMENT THIS AGREEMENT, entered into on or as of the ____ day of ________________, 20___, by and between the City of Galesburg, Knox County, Illinois, a municipal corporation, whose principal business address is 55 West Tompkins Street, Galesburg, Illinois, 61401, hereinafter referred to as “CITY” and Roanoke Concrete Products Co, and Illinois Corporation, whose principal business address is 1275 Spring Bay Road, East Peoria, IL 61611, hereinafter referred to as “OWNER”; and WHEREAS, OWNER is desirous of annexing to the City of Galesburg the real estate, as described in Exhibit A and mapped on Exhibit B, located in Galesburg Township, Knox County, Illinois, hereinafter referred to as “PROPERTY”; and WHEREAS, CITY desires to annex the PROPERTY, as described in Exhibit A; and WHEREAS, the said described real estate is contiguous to the corporate limits of the City of Galesburg; and WHEREAS, all parties, OWNER and CITY, have reached an agreement so as to insure to all parties that when PROPERTY is annexed, said PROPERTY conforms to the rules, regulations and ordinances of the City of Galesburg and the provisions in this preannexation agreement, and that all services provided by CITY shall be available to PROPERTY; and WHEREAS, OWNER has filed an Annexation Petition signed by the OWNER of record of the PROPERTY; and WHEREAS, notice of public hearing on this Agreement has been given in the manner provided by law, and the Corporate Authorities at the CITY have held such hearing as required by law. In consideration of the mutual promises herein contained, OWNER and CITY agree as follows: I. ZONING A. PROPERTY is currently zoned M, Restricted Industrial, in the County and will be zoned M2, Heavy Industrial as shown in Exhibit C, upon annexation to the City of Galesburg and shall extend to the center line of the adjacent right-of-way. B. The PROPERTY has an existing concrete mix plant in operation and the OWNER intends on continuing that business. The OWNER has requested a special use to be processed to allow the manufacture of cement & grinding, crushing, processing of minerals and earths at the PROPERTY. Should the Planning & Zoning Commission fail to approve the special use, the preannexation agreement and annexation ordinance are void. Page 3 of 9 II. SITE PLAN DEVELOPMENT A. OWNER and CITY acknowledge all uses in the M2 District require a site plan review process for all new construction or additions and changes in the use of existing buildings or parking lots which result in any exterior alteration or construction. III. ACCESS TO PROPERTY A. OWNER understands any access to Grand Ave (U.S. Highway 150) shall be in accordance with Illinois Department of Transportation requirements. IV. WATER MAINS A. An existing eight inch water main exists along the south side of Grand Ave. B. OWNER understands the costs to construct all water service taps and water service lines to serve the individual parcels are the responsibility of OWNER. C. Any private water service lines installed to serve the property shall be owned and maintained by the OWNER or future private property OWNER which is served by the water service line. D. OWNER agrees to provide for annual testing of all private fire hydrants by an Illinois Licensed Plumber or by the CITY Fire Department, provided OWNER signs a release of liability. If a plumber performs the test, OWNER agrees to provide documentation of the tests to the CITY Fire Department. V. FIRE PROTECTION A. Any fire hydrants installed on private water mains by OWNER and/or DEVELOPER on the PROPERTY shall be paid for by the OWNER and/or DEVELOPER per the CITY’S fire department recommendations. B. In general, hydrants will contain two 2 ½ inch outlets and one 4 ½ inch steamer connection with national standard thread. Fire hydrants are spaced according to City Code at five hundred feet minimum intervals and located within a reasonable distance to sprinkler and stand pipe connections to supply those fire protection systems during a fire incident. VI. SANITARY SEWERS A. OWNER acknowledges the sanitary sewer system is operated by the Galesburg Sanitary District and CITY has no responsibility or control over the provision of sanitary sewers to serve the PROPERTY. Page 4 of 9 B. OWNER agrees to contact the Galesburg Sanitary District directly and work out with the District how the PROPERTY will be served with sanitary sewer. VII. UTILITY INSTALLATION/EASEMENTS A. It is understood that any needed utility services required to be installed under Grand Ave shall be by means of pipe pushing or boring. B. OWNER understands all utilities serving the PROPERTY are required to be placed underground. VIII. STORMWATER DRAINAGE A. OWNER understands when development is proposed for the PROPERTY, a drainage plan that complies with CITY’S storm water drainage control requirements will need to be submitted to the City Engineer’s office. No construction permits will be issued until the drainage plan has been approved by the City Engineer’s office. B. OWNER understands at the time the drainage plan is submitted, the OWNER of the project must agree to construct and maintain the private storm water drainage lines and detention facilities as approved in the drainage plan. C. OWNER is responsible for obtaining an NPDES permit from IEPA for construction anytime they will be disturbing more than one (1) acre. As part of the IEPA requirements, OWNER is responsible for preparing a storm water pollution prevention plan (SWPPP). The SWPPP shall be approved by CITY prior to construction. D. OWNER shall be required to meet all state and local requirements with regard to diversion of stormwater. E. The OWNER is responsible for determining the location of any run off coming from offsite and designing its drainage plan to accommodate such runoff in accordance with the requirements of the CITY and approval of the Illinois Department of Transportation, where applicable. IX. MISCELLANEOUS A. OWNER shall indemnify, defend and hold the CITY and its officers officials, employees, agents, attorneys, engineers, planners and representatives harmless form and against any and all claims, lawsuits, actions, demands, judgments, damages, injuries, liabilities, losses, costs and expenses, specifically including attorney’s fees that may arise or be alleged to have arisen out of, in connection with, or relating to this Agreement or any of the approvals granted as part of this Agreement. B. This Agreement shall run with the land and as such, shall be assignable to and binding upon subsequent grantees and successors in interest of OWNER. Page 5 of 9 C. In the event that the annexation, rezoning or other actions taken with respect to the Property is in any way deemed to be defective, the parties agree that they will do all things necessary and appropriate to cure any and all defects to cause the Property to be validly annexed to the CITY and/or rezoned under the City’s Zoning Ordinance and that any other action is validly granted. D. This Agreement constitutes the entire agreement and understanding of the Parties relative to the subject matter hereof superseding all prior agreements, understandings and negotiations. This Agreement and the Exhibits attached hereto may be amended only by mutual consent of the parties as provided by law. Any such amendment shall be in writing and only after a Public Hearing was held regarding any Annexation Agreement amendment. The Exhibits attached to this Agreement are hereby made a part of this Agreement as if fully recited herein. E. This agreement shall be enforceable only in the Knox County Circuit Court by any of the parties hereto, their successors or assigns by an appropriate action at law or in equity to secure the performance of the covenants herein contained. The prevailing party shall be entitled to reasonable attorney’s fees and costs. F. OWNER and CITY each represent that they persons whose names appear below have full power and authority to execute this Agreement on behalf of the respective parties. G. The Planning and Zoning Commission is authorized to grant special use permits and to hear and decide upon applications for special use permits listed in the district regulations of this chapter.
