Approve Minutes of the November 19, 2019 meeting Member Johnson moved to approve the minutes, seconded by Member Thomas. Minutes were approved by voice vote. Update Past Planning and Zoning Commission items • Special use application to request the property be used for a Bar/Tavern, located at 162 West Main Street, P.I.N.99-15-201-004. This Special Use was denied at the last meeting. The business has since found a new location on South Cherry Street. • The Census Bureau will be mailing out information to household about mid-march regarding the 2020 Decennial Census and how to fill out forms. Forms can be completed online, via phone or regular mail. Receive Citizen Comment None Received. PZ-20-0201 Public Hearing Fence Variance Application for Menards, Inc., located at 2791 Veterans Drive. P.I.N. 95-35-326-001. Petitioner is Menards, who was present. The Commission members considered the following items: • The granting of the variance will not be detrimental to or endanger the public health, safety, morals, comfort or general welfare. • The granting of the variance will not be injurious to the use and enjoyment of other property in the immediate vicinity, nor substantially diminish or impair property values within the adjacent area. • The variance will not alter the essential character of the neighborhood. • The Development Review Committee reviewed the proposed variance at their February 5, 2020 meeting and recommend approval. The proposed preannexation agreement establishes M2, Heavy Industrial zoning for the property to be annexed. The Commission members considered the following items: • The Development Review Committee reviewed the proposed zoning amendment at their February 5, 2020 meeting and recommend approval Member Thomas moved, seconded by Member McKelvie to recommend approval of the proposed zoning for the parcel to be annexed. PZ-20-0203 Public Hearing Special use to allow a storage building and storage (mini-self- service) on two vacant lots south of 425 Home Blvd. Petitioner is James Duensing. The Commission members considered the following items: • The establishment of the special use will not impede the normal and orderly development and improvement of surrounding property for uses permitted in the district; and • The Development Review Committee reviewed the proposed special use at their February 5, 2020 meeting and recommend approval. Petitioner is Diamond Ag Group, Inc., who was present. The Commission members considered the following items: • The petitioner requested a waiver of the requirement to install public sidewalk. According to the petitioner’s engineer, the nearest public sidewalk is approximately 3,760 feet away. • The subdivision is in compliance with the Development Ordinance and would allow additional development to take place within the community. • The Development Review Committee reviewed the proposed Minor Plat at their February 5, 2020 meeting and recommend approval. The property under consideration is located at 2699 Grand Avenue. P.I.N: 99-24-226-009. The property is zoned Heavy Industrial (M2) and in that zoning district uses such as the manufacturing of cement and grinding, crushing and processing of minerals and earth (i.e. a concrete plant) is considered a Special Use, which requires the Development Review Committee to provide a recommendation to the Planning & Zoning Commission (P&Z) for their decision. Zoning is based upon the division of the city into districts, within any one of which the use of land and buildings and the bulk and location of buildings or structures as related to the land, are essentially uniform. It is recognized, however, that there are special uses which, because of their unique character, cannot be properly classified in any particular district or districts without consideration, in each case, of the impact of those uses upon the neighboring lands and upon public need for the particular use or the particular location. The property to the west is zoned Light Industrial (M1), to the east is zoned Multi-Family (R3A), to the south are county zoned properties that are Heavy Industrial (M2) and to the north is county zoned property that is Agriculture (A). The Development Review Committee members reviewed the special use request at their March 11, 2020 meeting. The Committee members recommended approval of the special use. Supporting Documents: 1. The Planning and Zoning Commission is authorized to grant special use permits and to hear and decide upon applications for special use permits listed in the district regulations of this chapter. Before authorizing the issuance of a special use permit, the Commission may impose any conditions that will, in the Commission’s judgment, ensure: (1) The proposed amendment is consistent with the intent of the Comprehensive Plan; (2) The establishment, maintenance or operation of the special use will not be detrimental to or endanger the public health, safety, morals, comfort or general welfare; (3) The special use will not be injurious to the use and enjoyments of adjacent properties for the purposes already permitted, nor substantially diminish and impair property values within the neighborhood; (4) The establishment of the special use will not impede the normal and orderly development and improvement of surrounding property for uses permitted in the district; (5) Adequate utilities, access roads, drainage and other necessary facilities will be provided; and (6) Adequate measures will be taken to provide ingress and egress so designed as to minimize traffic congestion on the public streets. (C) Transference. A special use permit shall not be transferred to another location; nor shall a special use permit be conveyed to another use at the same location. A new special use permit shall be required for either of these two changes. (D) Time limitations. The following time limitations shall apply to special use permits: (1) In cases where the use authorized by a special use permit requires a building permit, the applicant shall have three months from the date the special use permit is granted to apply for a building permit. If application has not been made within that time, the special use permit shall expire and become null and void; (2) In cases where a building permit is not required, any construction or activity authorized or required pursuant to the special use permit must commence within three months from the date the special use is granted. In the event the construction or activity is not commenced within the three-month period, the special use permit shall expire and become null and void; and (3) Any other time restrictions as detailed The property is located at 385 Day St. The property owner is wanting to construct an open front deck on the home. The proposed deck will be 10 feet out from the house and 16 feet wide. The property is zoned Two-Family (R2), which allows an open/unenclosed front porches to have a front yard setback of 15 feet. The proposed deck would have a 13 foot setback, so the owner is requesting a variance of Section 152.031 (c) (2) (a) of the Development Ordinance to allow a 2 foot variance. If approved, it would be a 13 foot setback instead of the required 15 feet. By ordinance, variance reductions may not exceed 30% of what is required and in this case, if approved, it would be a 13.33% reduction. (1) The Planning and Zoning Commission shall not vary the provisions of this chapter as authorized in this section unless it shall have made affirmative findings based upon the evidence presented to it in each of the following specific cases: (a) That the property in question cannot yield a reasonable return if permitted to be used only under the conditions allowed by the regulations governing the district in which it is located. Applicants must submit evidence identifying the price paid for the property. Paying more for the property than it is worth, purchasing it at a price which anticipates and obtains variances, or showing that the property would be worth more if a variance is granted is not evidence of lack of a reasonable return; (b) That the situation of the owner is due to unique physical circumstances of the property; and (c) That the variance, if granted, will not alter the essential character of the neighborhood. (2) For the purpose of supplementing the above standards, the Planning and Zoning Commission, in making this determination whenever there are practical difficulties or particular hardships, shall also take into consideration the extent to which the following facts, favorable to the applicant, have been established by the evidence: (a) That the particular physical surroundings, shape or topographical conditions of the specific property involved would bring a particular hardship upon the owner as distinguished from a mere inconvenience if the strict letter of the regulation were to be carried out; (b) That the conditions upon which the petition for variance is based would not be applicable generally to other property within the same zoning classification; (c) That the purpose of the variance is not based exclusively upon a desire to make more money out of the property; (d) That the alleged difficulty or hardship has not been created by any person presently having an interest in the property; (e) That the granting of the variance will not be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located; and (f) That the proposed variance will not impair an adequate supply of light and air to adjacent property, substantially increase the danger of fire, otherwise endanger the public safety, or substantially diminish or impair property values within the neighborhood.
