Approve Minutes of the February 18, 2020 meeting Member Uhlmann moved to approve the minutes, seconded by Member McKelvie. Minutes were approved by voice vote. Update Past Planning and Zoning Commission items • Fence Variance Application for Menards, Inc., located at 2791 Veterans Drive. P.I.N. 95-35-326- 001. We expect an application to construct the fence soon. • Proposed preannexation agreement that establishes an M2 zoning district for a property, located at 2699 Grand Ave. The City Council approved the preannexation agreement and preannexation ordinance at their March 16, 2020 meeting. • Special use to allow a storage building and storage (mini-self-service) on two vacant lots south of 425 Home Blvd. The P&Z Commission approved this Special Use request. • Minor Plat of the Oskee Subdivision, located south of the US 150 and Knox Hwy 10 intersection. The City Council approved this Minor Plat at their March 2, 2020 meeting. • The U.S. Constitution mandates a census of the population every 10 years. The 2020 Census will count everyone who lives in the U.S. as of April 1, 2020. The 2020 Census is more than a population count, it’s an opportunity to shape your community’s future. An accurate count helps inform decisions about funding for hospitals, fire departments, schools, housing, and roads for the next 10 years. Households that receive the 2020 Census invitation packets are strongly encouraged to respond promptly to the 2020 Census. People can respond online, by phone or by completing and returning the paper form by mail. Online, phone and mail response deadlines have been revised and will now be accepted until October 31, 2020. PZ-20- 0601SP Public Hearing Special use to allow manufacturing of cement and grinding, crushing and processing of minerals and earth (i.e. a concrete plant) located at 2699 Grand Ave. P.I.N: 09-24-226-009. Page 2 of 3 The Commission members considered the following items: • The establishment, maintenance or operation of the special use will not be detrimental to or endanger the public health, safety, morals, comfort or general welfare; • The special use will not be injurious to the use and enjoyments of adjacent properties for the purposes already permitted, nor substantially diminish and impair property values within the neighborhood; • The establishment of the special use will not impede the normal and orderly development and improvement of surrounding property for uses permitted in the district; • Adequate utilities, access roads, drainage and other necessary facilities will be provided; and • Adequate measures will be taken to provide ingress and egress so designed as to minimize traffic congestion on the public streets. • The Development Review Committee reviewed the proposed special use at their March 11, 2020 meeting and recommend approval. PZ-20- 0602SP Public Hearing Variance request of Section 152.031 (c) (2) (a) of the Development Ordinance to allow a front yard setback of 13 feet instead of the allowed 15 feet, located at 385 Day St. Petitioner is Eric Lewis, who was present. The Commission members considered the following items: • The granting of the variance will not be detrimental to or endanger the public health, safety, morals, comfort or general welfare. • The granting of the variance will not be injurious to the use and enjoyment of other property in the immediate vicinity, nor substantially diminish or impair property values within the adjacent area. • The variance will not alter the essential character of the neighborhood. • The Development Review Committee reviewed the proposed variance at their May 6, 2020 meeting and recommend approval. The applicant is requesting a variance of Section 152.232(A) of the Development Ordinance to allow more than one on-premise free-standing sign. Edward Jones will have an office inside the Heritage Credit Union building. The credit union already has an existing on-premise free-standing sign on the property. A permit issued in 2002 shows the Heritage Credit Union pole sign is 20 feet in height and the sign face is (6x16) 96 square feet. The variance request will allow Edward Jones to install their own, separate, on-premise free- standing sign. This proposed monument style sign will be 6 feet 1 inch high from grade and the sign face will be 16.67 square feet. The property is located in a General Business District (B2) and is surrounded on all four sides by properties zoned B2. (A) Appeals. Hear and decide appeals by the sign permit applicant where it is alleged there is an error in any order, requirement, decision or determination made by the Building Inspector in the enforcement of this subchapter; (B) Variances. Grant varian ces from the requirements of this subchapter and §§ 152.205 through 152.220 or 152.230 through 152.233 where the Building Inspector has denied granting a sign permit as a result of noncompliance with the requirements of these subchapters. (C) Criteria for decision. The Planning and Zoning Commission shall have the power to grant a variance from the provisions or requirements of this subchapter only where the following criteria have been considered: (1) The literal interpretation and strict application of the provisions and requirements of this subchapter would cause undue and unnecessary hardship to the sign user because of unique or unusual conditions pertaining to the specific building or property in question; (2) The granting of the requested variance would not be detrimen tal to or endanger the public health, safety, morals, comfort or general welfare; (3) The granting of the variance would not be injurious to the use and enjoyment of other property in the immediate vicinity, nor substantially diminish or impair property values within the adjacent area; (4) The unusual conditions applying to the specific property do not apply generally to other buildings or properties in the city; and (5) The granting of the variance will not be contrary to the general objectives set forth in § 152.019. (D) Determination of conditions. The proposed subdivision is includes 932 and 1000 Monmouth Blvd, which are Property Identification Numbers 99-16-426-007, 99-16-426-006 and 99-16-426-008. The Development Review Committee members reviewed the Minor Plat at their June 10, 2020 meeting and recommend approval, with the condition the following items be addressed: 1. Show existing sanitary and storm sewers, water mains, fire hydrants, culverts and other underground structures within the tract or on streets immediately abutting thereto; the location and size of the nearest water main and sewer outlet 2. Written confirmation of adequate capacity from the Galesburg Sanitary District. 3. If any new easements are being proposed, provide written confirmation you have notified and given all utility companies time to review the proposed easement locations. 4. Change the title from “Final Plat” to “Minor Plat”. 5. In the owner’s notarized statement, add language that states, to the best of the owner’s knowledge, the subdivision is located within the boundaries of Galesburg Community Unit School District #205, Knox County, IL. 6. The PIN for existing lot 15 needs to be shown on the Minor Plat as well 99-16-426-007. 7. Along Monmouth Blvd the proposed plat shows the measurements as 128.96’ and 64.62’, when added together equal 193.58’ but the overall measurement on the plat shows 193.63’. 8. In the surveyor certification add language similar to the below statements: • I also state that to the best of my knowledge the land is within the corporate limits of the City of Galesburg, which has adopted a city plan and is exercising the special powers authorized by Division 12 of Article 11 of the Illinois Municipal Code, as now or hereafter amended. • I further state that the above described property (is or is not) situated within a special flood hazard area as identified by the FEMA community panel number (insert number) dated (insert date). 9. Include a certificate and/or acknowledgement for the County Clerk, Planning & Zoning Commission, City Council, Supervisor of Assessments. The application requests a rezoning of the property from B1, Neighborhood Business to B2, General Business. The owners of Lux Blox, LLC are in the process of receiving ownership of the property with the building and adjacent vacant lot from the current owner. The owners of Lux Blox, LLC intend on using the building to assemble and ship products. The B2 zoning district would allow Retail, Packaging of products and services and a Mail order store all as Permissive uses. The attached aerial shows the general location of the lot in question and the existing zoning. To the north are properties that are zoned as Neighborhood Business (B1) and Multi-family (R3A), to the west and south are zoned Neighborhood Business (B1) and to the east the property is zoned General Business (B2) . The purpose of the B2 zoning district is to provide a wide range of businesses and services relying upon the patronage from areas beyond the immediate neighborhood in which they may be located. Zoning map amendments may be approved if the City Council reviews all of the following criteria: (1) The proposed amendment is consistent with the intent of the Comprehensive Plan; (2) The proposed amendment corrects an error or inconsistency or addresses some changing condition in the area; if the change is inconsistent with the Comprehensive Plan and the rezoning is approved, the Comprehensive Plan should be amended to reflect this change in use; (3) The proposed amendment will allow development that is compatible with existing uses and zoning of nearby property; (4) The city and other service providers will be able to provide adequate public facilities and services to the subject property, while maintaining adequate levels of service to existing development; (5) The proposed amendment will not result in significant adverse impacts on other property in the vicinity of the subject tract or on the environment, including air, water, noise, stormwater management, wildlife and natural resources; and (6) The subject property is suitable for the proposed zoning classification. (1) The Planning and Zoning Commission shall not vary the provisions of this chapter as authorized in this section unless it shall have made affirmative findings based upon the evidence presented to it in each of the following specific cases: (a) That the property in question cannot yield a reasonable return if permitted to be used only under the conditions allowed by the regulations governing the district in which it is located. OSF is requesting a variance of Section 152.231(B)(1) to install 2 additional wall signs, which will bring the total to 4 wall signs, instead of the allowed 1 wall sign per business. OSF has undergone numerous renovations and additions to their facility. In September 2018, they requested and received a similar variance to allow an increase to the number of allowed wall signs to install the now existing sign on the south elevation. In June 2019, the City Council approved an amendment to their meeting time so that they now also begin at 5:30 p.m.. If approved, this change in the Planning and Zoning Commission meeting time to 5:30 p.m. would put it in line with the City Council. This would only be a time change, the day would remain the second to last Tuesday of the month. cc: File Copy
