(A) Appeals. Hear and decide appeals by the sign permit applicant where it is alleged there is an error in any order, requirement, decision or determination made by the Building Inspector in the enforcement of this subchapter; (B) Variances. Grant varian ces from the requirements of this subchapter and §§ 152.205 through 152.220 or 152.230 through 152.233 where the Building Inspector has denied granting a sign permit as a result of noncompliance with the requirements of these subchapters. (C) Criteria for decision. The Planning and Zoning Commission shall have the power to grant a variance from the provisions or requirements of this subchapter only where the following criteria have been considered: (1) The literal interpretation and strict application of the provisions and requirements of this subchapter would cause undue and unnecessary hardship to the sign user because of unique or unusual conditions pertaining to the specific building or property in question; (2) The granting of the requested variance would not be detrimen tal to or endanger the public health, safety, morals, comfort or general welfare; (3) The granting of the variance would not be injurious to the use and enjoyment of other property in the immediate vicinity, nor substantially diminish or impair property values within the adjacent area; (4) The unusual conditions applying to the specific property do not apply generally to other buildings or properties in the city; and (5) The granting of the variance will not be contrary to the general objectives set forth in § 152.019. (D) Determination of conditions. The property owner did receive a Certificate of Appropriateness for project on his property, which included fencing, at the September 5, 2018 Landmark Commission meeting. The Landmark Commission reviews improvements visible from a public way to assure the activity proposed will not adversely affect the historical or architectural character of the property or area. The Landmark Commission does not have the authority to give variances to zoning regulations (i.e. fence heights), that authority lies with the Planning and Zoning Commission. (1) The Planning and Zoning Commission shall not vary the provisions of this chapter as authorized in this section unless it shall have made affirmative findings based upon the evidence presented to it in each of the following specific cases: (a) That the property in question cannot yield a reasonable return if permitted to be used only under the conditions allowed by the regulations governing the district in which it is located. Applicants must submit evidence identifying the price paid for the property. Paying more for the property than it is worth, purchasing it at a price which anticipates and obtains variances, or showing that the property would be worth more if a variance is granted is not evidence of lack of a reasonable return; (b) That the situation of the owner is due to unique physical circumstances of the property; and (c) That the variance, if granted, will not alter the essential character of the neighborhood. (2) For the purpose of supplementing the above standards, the Planning and Zoning Commission, in making this determination whenever there are practical difficulties or particular hardships, shall also take into consideration the extent to which the following facts, favorable to the applicant, have been established by the evidence: (a) That the particular physical surroundings, shape or topographical conditions of the specific property involved would bring a particular hardship upon the owner as distinguished from a mere inconvenience if the strict letter of the regulation were to be carried out; (b) That the conditions upon which the petition for variance is based would not be applicable generally to other property within the same zoning classification; (c) That the purpose of the variance is not based exclusively upon a desire to make more money out of the property; (d) That the alleged difficulty or hardship has not been created by any person presently having an interest in the property; (e) That the granting of the variance will not be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located; and (f) That the proposed variance will not impair an adequate supply of light and air to adjacent property, substantially increase the danger of fire, otherwise endanger the public safety, or substantially diminish or impair property values within the neighborhood. IL 61401 • 309 345-1619 Updated December 2020 Page 6 of 6 Attachment (1): EXPLAIN THE REASON FOR THE VARIANCE REQUEST I respectfully submit a variance request for historic wrought iron fence to be installed around the west, south, and a portion of the north side of my home. The fence that I would like to use is slightly higher than the current City of Galesburg fence ordinance. The top of the finials of the fence to potentially be used on the west and south sides of my home measures slightly above 5 feet {5', 3"}. The fencing to be used on a portion of my north property line measures approximately 4', 6". Photographs of the fence are attached (Attachment 2). You will note, it allows ample view of the property. Rationale for the fencing: In 2018, I approached the Galesburg Landmark Commission (GLC) regarding the potential use of the historic hand-forged wrought iron fence . The fence was initially installed at the Lawrence House {490 North Prairie Street). The owners of that house allowed me to purchase the fence. At the September 5, 2018 GLC meeting, the use of the fencing was approved (Attachments 3,4,5}. I verbally mentioned the size of the fence as was told that it did not need to be presented to planning and zoning. Unfortunately, this was not reflected in writing or in the meeting minutes. I then proceeded to seek a firm that would be willing to restore and professionally install the fencing . After over twelve months of searching and numerous failed attempts, I located Prairie State Ironworks in Edwards, Illinois. The firm agreed to proceed with managing restoration and installation. After great expense, significantly more than a hollow core aluminum fence would cost, the historic fencing is ready to install. Upon requesting a fence permit, I was notified that the fence was not compliant. To make the current fence conform to the 4 feet height requirement would require massive work at significant expense (more than $60,000). It would also most likely degrade the appearance of the fencing and potentially change the historic appearance. Please note, the taller fencing must be used on the front and southside. Unfortunately, there is not enough of the shorter fence to run along the west (front) side of the property. The site plan explains the exact location of the fencing (Attachment 6). My hope is to continue to enhance this historic and architecturally significant home. I respectfully request that the commission grants my project a variance to meet this goal. I will have a more specific materials list for the meeting on Wednesday, September 5 th . Additionally, I would like to request that the committee allows me to place fencing around the perimeter of the property. My goal is to combine the parcels of 455 North Prairie and 473 North Prairie Street. Please note, 473 North Pra i rie Street is not historically protected and outside the purview of the Landmark Commission. The structure will be razed w ithin the month, once final permits are obtained . I will follow all required zoning rules to obtain this permission. Mark and Jeannette Kleine were kind enough to give me the original wrought iron fencing that surrounded the sides and rear of the Lawrence House. If the price of the project does not exceed my budget, rust will be removed and the fencing will be repainted. It will then be professionally installed in the front of the Smith-Moreland House and on the north and south sides of the property. As indicated in the 1876 photo, there was originally fencing in front of the house. On the south side of the property, the fencing will die into my neighbor's fence, which is along the property line. On the northside of the property, the fencing will die into an elevation change and larger privacy fencing . This will occur behind the front porch line of my neighbor's home. I will request a permit from the City of Galesburg for the fence installation. The new privacy fencing will be installed along the northside of the property (past the wrought iron) and in the rear (eastside) of the property. If my budget allows, and pending a city resolution with the alley (underway), I will install a gate that similarly matches the fencing to the entrance of my property. Pending permitting, approvals, etc . I hope to start this project this fall. I am unsure my timeline is realistic. If I cannot make it on a contractor's schedule, I may wait until the spring for the fencing portion of the property. Attachment 5 : GLC Minutes MINUTES GALESBURG LANDMARK COMMISSION ERICKSON CONFERENCE ROOM OF GALESBURG CITY HALL REGULAR MEETING Wednesday, September 5, 2018 at 6:00 p.m. MEMBERS PRESENT: Suzanne Klahn, Mark Martin (arrived at 6:18), Robert Miener, Paul Stewart, and Greta Woolsey , 5. MEMBERS EXCUSED ABSENT: Michael Fries and Roger Reynolds , 2. OTHERS PRESENT: Judy Guenseth, Housing Coordinator. Chairperson Stewart declared a quorum was present. The meeting began at 6:05 p.m. Approve Minutes of August 1, 2018 Member Miener made a motion to approve the minutes, seconded by Member Woolsey . Minutes were approved by voice vote. Consider Citizen Comment None Consider Staff Comment Ms. Guenseth presented the Register Mail article on a special Civil War service held at the Central Congregational Church in August. Member Klahn expounded on what her church has being doing to encourage more activities like the one in the article . Ms . Guenseth also presented a memo written by Planning Manager Steve Gugliotta discussing LIHTC and Historic Preservation tax incentives . She explained that these incentives are organized under the IRS and would assist developers with income tax incentives. She also explained the process is very complicated and is best pursued with a good accountant or attorney . Mr. Vitale also commented that he was trying to pursue these credits and it is a tremendous amount of paperwork. Finally, she brought up the 25th Annive rsary Preservation Awards , but Chairman St ewart said he was going to discuss this topic later in the meeting . LC-18-0901 Consider Certificate of Appropriateness for 455 North Prairie Street Mr. Adam Vitale is requesting a Certificate of Appropriateness for his home located on North Prai ri e Street. Mr. Vitale is seeking a Certificate of Page 1of3 Appropriateness to build a garage on his property. The previous garage (not the original) was damaged by a tree and was removed. He did state that the home had a carriage house in its early history. He presented updated drawings of the garage. He stated new construction in historic areas needed to look different but complement the existing structure. The front windows of the garage are arched similar to the windows of his home. The garage will be facing west, the same direction as the house. The height of the garage was discussed and Mr. Vitale is aware that he will need to get a height variance from the Planning and Zoning Commission if his plan to build the garage is approved. Mr. Vitale also presented an early picture of the house with a picket fence and a picture of a wrought iron fence to be installed. He plans to install the iron fence toward the front of the property but will install a privacy fence in the back portion. He also intends to install landscaping in front of the fence. He also discussed the removal of the home north of him. He stated the home was in deplorable condition but is using building material from the home as much as possible to use in the restoration of 455 N. Prairie. The commission members expressed appreciation for this . Member Woolsey moved, seconded by Member Miener to approve the Certificate of Appropriateness for 455 North Prairie Street. LC-18-0902 Discuss Items from the Chairperson Paul Stewart brought up the 25 th Anniversary Preservation Awards in Chicago on September 15, 2018. He would like to go as he has in the past and asked if the commission would sponsor him. Member Woolsey moved to have Chairman Stewart go to the awards and for the commission to pay the $50 ticket price. This was seconded by Member Martin. There were 4 ayes and 1 abstention . Chairman Stewart also discussed the Scott home rehabilitation that was highlighted in the Register Mail.
