Chairman declared quorum present. Approve Minutes of the June 22, 2021 meeting Member Uhlmann moved to approve the minutes, seconded by Member Thomas. Minutes were approved by voice vote. Update Past Planning and Zoning Commission items • Special Use to allow Storage Units (mini/self-service), located at 140 S Prairie St PIN 99-15- 230-014.The Special Use was approved. • Special Use to allow Storage Units (mini/self-service), located at 962 E Main St. PINs 99-14- 127-004 and 99-14-127-010.The Special Use was approved and the petitioner recently closed on purchasing the property. Receive Citizen Comment None Received. PZ-21-0601 Public Hearing Amendment to Preannexation Agreement to allow a third ingress/egress along East Carl Sandburg Drive for Knox Family Dental. PINs 99-03-226-005. The petitioner, Petoskey Realestate, LLC was present. At their May 19, 2014 meeting, Council voted on a resolution approving a Pre-annexation Agreement for what was a vacant parcel at the southwest corner of North Seminary Street and East Carl Sandburg Drive. Section III of that Agreement limited access to the property along both East Carl Sandburg Drive and North Seminary Street to specific locations. One was approximately 425 feet west of the centerline of North Seminary St for an access and private drive (this is the access for Casey’s and the car wash) and the second point was approximately 550 feet west of the centerline of North Seminary Street for a City street to serve commercial lots (this is Dahl Drive). The intent was to reduce vehicular congestion and the installation of Dahl Dr was to provide necessary access to the lot in question. Adjacent to and west of the property being discussed, is a strip of land zoned Single Family (R1C). If this property is developed as a residential subdivision in the future, it will also require an access point onto Page 2 of 3 East Carl Sandburg Drive. This lot is not part of the pre-annexation agreement, but if developed this access will also generate another access point and vehicular traffic. In looking at the proposed site layout provided by the developer, it would appear options are available without the need to have an access off of E. Carl Sandburg Dr. For example, an access easement could be recorded now on the south end of the lot, from Dahl Drive westerly. The pavement would not have to be installed now, but at a later date should development occur. Another option may be to have a private access road could come off of Dahl Drive on the north side of the lot going westerly to serve the west portion of the lot and some parking could be placed in the south end of the lot. The petitioner mentioned the access on the north side of their lot off of Dahl Dr was not an optimal location as it may cause issues as vehicles come off of E. Carl Sandburg Dr and then have to quickly turn into their lot. It was mentioned that E. Carl Sandburg Dr does have a center turn lane that could be utilized by vehicles traveling westbound on E. Carl Sandburg Dr to pull into awaiting to turn into the lot. Member Thomas stated he felt the access off of E. Carl Sandburg Dr would be better for the future development of the west portion of the lot. The Commission members considered the following items: • The Development Review Committee reviewed the proposed variance at their August 4, 2021 meeting and recommend denial due to other options being available and a concern about vehicular congestion as future development occurs. Member Thomas moved, seconded by Member Uhlmann to recommend approval of the amendment to the Preannexation Agreement. Roll Call #1 Ayes: Johnson, Thomas, Uhlmann, 3. Nays: None. Abstentions: None. Chairperson declared the motion approved. PZ-21-0602 Public Hearing Minor Plat of the Seminary Square Commercial Resubdivision No 3, located at 2616 Veterans Dr, PIN 95- 35-353-006. Jeff Johnson was present on behalf of F&M Bank. The Commission members considered the following items: • Adequate utilities, access roads, drainage and other necessary facilities will be provided; • Adequate measures will be taken to provide ingress and egress so designed as to minimize traffic congestion on the public streets. SUMMARY RECOMMENDATION: The Development Review Committee members reviewed the zoning amendment request at their September 1, 2021 meeting and recommended approval. It is anticipated the recommendation of the Planning and Zoning Commission would then go to City Council at their October 4th meeting on first reading and October 18th on final reading. BACKGROUND: Attached for the Commission’s review is a zoning map amendment application received from the owner FHP&D Properties, Ryan Frakes. The application requests a rezoning of the property from I, Institutional to B1, Neighborhood Business. This would include 387 E Grove St and the parking lot to the south (across E Grove St). Property identification numbers are 99-10- 428-020 and 99-10-431-015. The owner recently purchased the property and is requesting the zoning amendment so they can operate an indoor climate controlled Storage (mini-self service) business in a portion of the building. This item is related to PZ-21-0902, where they are requesting a Special Use. The attached aerial shows the general location of the lot in question and the existing zoning. (3) Dressmaking, tailoring, shoe repair, upholstering and similar trade where not more than five persons are employed on the premises at any one time; (4) Garden supply store or greenhouse, provided they do not exceed 15,000 square feet; (5) Laundromat or dry cleaning establishments that do not exceed ten employees on the premises at any one time; (6) Parking lots, but only as an accessory use for customer and employee parking located on the site. Storage of construction vehicles is specifically not permitted in parking lots; and (7) Restaurant (any size with a drive- through subject to the conditions established in § 152.134(N)). (D) Special uses. The following uses require a special use permit: (1) Adult entertainment establishment, subject to the provisions outlined in § 152.115; (2) Arcade; (3) Catering service; (4) Cocktail lounge, bar or tavern, or nightclub; (5) Convenience store with gas pumps; (6) Crematory; (7) Gun shop; (8) Halfway house, subject to the provisions outlined in § 152.113; (9) Mail order store; (10) Miniature golf course (indoor); (11) Pet shop; (12) Pool hall; (13) Service and repair establishment, including dyeing or cleaning works or laundry, electrical, plumbing and HVAC, printing, painting, upholstering or appliance repair; (14) Sign shop; (15) Skating rink (outdoor); (16) Theater (not including drive-in theaters); and (17) Trade or business school. (18) Storage (mini, self-serve), subject to the following conditions; maximum height of one story; and a maximum building coverage of 30% of the site. (E) Height limits. No building or structure shall be erected or structurally altered to exceed 35 feet. Height limits may be exceeded in accordance with the provisions outlined in § 152.030. (F) Minimum yards. Every building hereafter erected or enlarged shall provide and maintain: (1) Front yard not less than 20 feet; (2) No minimum side yards. If provided, must be at least five feet; (3) Rear yard not less than 20 feet; and (4) Minimum yards may be exceeded in accordance with the provisions outlined in § 152.031. (G) Minimum lot areas and widths. (1) Single-family dwellings shall have a minimum lot area of 7,500 square feet and width of 60 feet. All other uses shall have no minimum lot area. (2) Except for single-family dwellings, no minimum lot width shall be required in the B1 District. SUMMARY RECOMMENDATION: The Development Review Committee members reviewed the special use request at their September 1, 2021 meeting and recommended approval. This item is related to PZ-21-0901, where they are requesting a zoning amendment. The zoning amendment will go on to City Council, but a Special Use request does not. Due to this timing issue, it is recommended that if the Planning and Zoning Commission should approve the Special Use that approval is contingent upon the approval of the zoning amendment by City Council. It is also recommended any approval of a Special Use include a condition that the north and west property lines along the parking lot on the north side of the building have fences or evergreen shrubs as a separation/buffer between the commercial and residential uses. Due to this timing issue, it is recommended that if the Planning and Zoning Commission should approve the Special Use that approval is contingent upon the approval of the zoning amendment by City Council. It is also recommended any approval of a Special Use include a condition that the north and west property lines along the parking lot on the north side of the building have fences or evergreen shrubs as a separation/buffer between the commercial and residential uses. The Planning and Zoning Commission is authorized to grant special use permits and to hear and decide upon applications for special use permits listed in the district regulations of this chapter. Before authorizing the issuance of a special use permit, the Commission may impose any conditions that will, in the Commission’s judgment, ensure: (1) The proposed amendment is consistent with the intent of the Comprehensive Plan; (2) The establishment, maintenance or operation of the special use will not be detrimental to or endanger the public health, safety, morals, comfort or general welfare; (3) The special use will not be injurious to the use and enjoyments of adjacent properties for the purposes already permitted, nor substantially diminish and impair property values within the neighborhood; (4) The establishment of the special use will not impede the normal and orderly development and improvement of surrounding property for uses permitted in the district; (5) Adequate utilities, access roads, drainage and other necessary facilities will be provided; and (6) Adequate measures will be taken to provide ingress and egress so designed as to minimize traffic congestion on the public streets. (C) Transference. A special use permit shall not be transferred to another location; nor shall a special use permit be conveyed to another use at the same location. A new special use permit shall be required for either of these two changes. (D) Time limitations. The following time limitations shall apply to special use permits: (1) In cases where the use authorized by a special use permit requires a building permit, the applicant shall have three months from the date the special use permit is granted to apply for a building permit. If application has not been made within that time, the special use permit shall expire and become null and void; (2) In cases where a building permit is not required, any construction or activity authorized or required pursuant to the special use permit must commence within three months from the date the special use is granted. The buildings were built in 1974-1975 by Don Cantrell, who operated an equipment rental business there until approx. 1995. At that point the business was sold, and an equipment rental business continued to operate at that location under multiple owners until we purchased the property in March of 2008. We continued to operate an equipment rental business there until we began to move our operations in December of 2020. We maintained part of our equipment and inventory storage at the 148 W Simmons St. until we completed our move in mid April of this year. We understand that we were a non conforming use in B-1 zoning, and have had prior discussions with City of Galesburg personnel on this topic. We have always complied with whatever they asked us to do, and we continue to do so. We are in the process of selling this property to John’s Plumbing, owners John Moore and John Steele. Their business would involve much less traffic, noise and potential disruption of the neighborhood that our equipment rental did. In the spirit of mutual cooperation and doing what is in the best interest of the City of Galesburg, and all interested parties, I hope that the City of Galesburg will allow this business to operate as a non conforming business in our old location. SUMMARY RECOMMENDATION: The Development Review Committee members reviewed the ordinance amendment at their September 1, 2021 meeting and recommended approval. BACKGROUND: The current Community Garden ordinance was approved on May 3, 2010. The ordinance would allow Community Gardens or private gardens as a primary use on a vacant lot if it meets the conditions of Section 152.118. This is applicable to the Estate Residential (ER), Single Family (R1A, R1B and R1C) zoning districts. The proposed amendment would now include allowing Community Gardens in the Institutional zoning district. The amendment would also exempt any Community Garden that is maintained by the United States of America, State of Illinois, any unit of local government, primary school, secondary school or college. City ordinance defines a Community Garden as “An area of land managed and maintained by a group of individuals to grow and harvest food crops and/or non-food ornamental crops, for personal or group use, consumption or donation. Community gardens may be divided into separate plots for cultivation by one or more individuals or may be farmed collectively by members of the group and may include common areas maintained and used by group members. The activities shall not include commercial/entrepreneurial/for profit enterprises.” Community Gardens promote local health, can provide neighborhood beautification, and/or education. These amendments will provide more flexibility that could increase community involvement and overall health through sustainable methods of food production. Supporting Documents: 1. Community garden or private garden as a primary use on a vacant lot provided the following conditions are met: (A) The garden area shall be limited to growth of vegetables, fruits and flowers only. Maintaining beehives, livestock and poultry shall be prohibited. (B) No garden area shall be located in the FRONT YARD AREA which is defined as the required front yard setback distance for the zoning district in which the community garden is located or the average distance between the front property line and the font of the adjacent buildings, whichever distance is less. (C) A grassy buffer strip at least three feet wide shall be provided along the side and rear property lines. (D) The garden area shall be properly maintained throughout the year by: (1) Weekly mowing the grassy areas. (2) Weekly removing the weeds and grasses from the actual garden. (3) Weekly collecting rotting vegetables/fruits from garden areas and providing off-site disposal of this waste. (4) Weekly collecting and removing all trash and debris this is deposited on the site. (5) Providing for all season end removal of all dead plant growth/waste. (E) No overhead lighting shall be permitted on the site. (F) One non-illuminated sign no exceeding four square feet in area and six fee in height shall be permitted. The sign face shall be located parallel to the front property line and shall not be located in the front yard area. The content of the sign shall be limited to identification of the site as a community garden, sponsorship contact information and rules/guidelines for the community garden. (G) No parking areas shall be permitted on the site. (H) No retail sales of product shall be allowed on the site. (I) No portable restrooms shall be permitted on the site. (J) One utility shed shall be allowed on the site under the following conditions: (1) Maximum area of 150 square feet. (2) Must be located within the rear yard setback and at least five feet off the side and rear property lines. (3) Maximum height of ten feet. (K) Any power equipment and attachments, hand tools, fertilizer, chemicals and other equipment and materials that is kept on the site shall be stored within a utility shed. (L) The following miscellaneous improvements shall be permitted on the site: (1) Trellises. (2) Raised planting beds (3) Benches. (4) Covered trash receptacles. (5) Row covers. (M) Hours of operation shall be limited from sunrise to sunset. (N) Row covers are permitted to provide the extension of the growing season. Any row cover shall be limited to a maximum width of six feet wide and a maximum height of five feet tall. Row covers can be utilized between March 1 and May 31 and between September 1 and December 1. At all other periods the row cover shall be removed from the site. The row cover structure shall be properly maintained while placed in the garden and the fabric covering the structure shall be repaired or replaced if the material rips or becomes loose. SUMMARY RECOMMENDATION: The Development Review Committee members reviewed the variance request at their September 1, 2021 meeting and recommended approval. BACKGROUND: Attached for the Commission’s review is variance application received from Klingner & Associates on behalf of Solid Rock Properties, LLC. They are proposing an approximate 2,613 square foot addition that would remove some parking spaces. They do plan on adding a few parking spaces in other areas where they can, but the end result will be 82 parking spaces provided. The existing 4 ADA parking spaces are included in that count and will remain. The owner is seeking a variance of Table 152.155 (B) (2), which would require a restaurant with a drive-through to provide 1 parking space per 3 seats, plus 3 per cashier station. The original construction drawings show 200 seats and 3 cashier stations, which would require 76 parking spaces. The addition will increase the number of seats by 30, which would require an additional 10 spaces. This is a total of 86 parking spaces required and after the addition they will have 82. Section 152.019 (B) (6) states a parking variance request can only be up to a maximum of 50% of the requirement. This request is asking to reduce parking by 4 spaces, which is a 4.7% variance request. The Planning and Zoning Commission is authorized to grant special use permits and to hear and decide upon applications for special use permits listed in the district regulations of this chapter. Before authorizing the issuance of a special use permit, the Commission may impose any conditions that will, in the Commission’s judgment, ensure: (1) The proposed amendment is consistent with the intent of the Comprehensive Plan; (2) The establishment, maintenance or operation of the special use will not be detrimental to or endanger the public health, safety, morals, comfort or general welfare; (3) The special use will not be injurious to the use and enjoyments of adjacent properties for the purposes already permitted, nor substantially diminish and impair property values within the neighborhood; (4) The establishment of the special use will not impede the normal and orderly development and improvement of surrounding property for uses permitted in the district; (5) Adequate utilities, access roads, drainage and other necessary facilities will be provided; and (6) Adequate measures will be taken to provide ingress and egress so designed as to minimize traffic congestion on the public streets. (C) Transference. A special use permit shall not be transferred to another location; nor shall a special use permit be conveyed to another use at the same location. A new special use permit shall be required for either of these two changes. (D) Time limitations. The following time limitations shall apply to special use permits: (1) In cases where the use authorized by a special use permit requires a building permit, the applicant shall have three months from the date the special use permit is granted to apply for a building permit. If application has not been made within that time, the special use permit shall expire and become null and void; (2) In cases where a building permit is not required, any construction or activity authorized or required pursuant to the special use permit must commence within three months from the date the special use is granted.
