Chairman declared quorum present. Approve Minutes of the October 19, 2021 meeting Member Thomas moved to approve the minutes, seconded by Member Uhlmann. Minutes were approved by voice vote. Update Past Planning and Zoning Commission items • Zoning map amendment to go from I, Institutional to B2, General Business, located at a portion of a property located west of 876 W Main St. The City Council approved the amendment at their November 15th meeting. • Ordinance amendment to add a definition and provisions for Residential Gardens. This item was removed from the November 15th Council agenda. Receive Citizen Comment None Received. PZ-22-0101 Public Hearing Variances of setback, fence height and variance duration for Blackberry Solar, LLC, located in the 1400 block of South Farnham Street, PIN 99-24-151-003. The petitioner was Blackberry Solar, LLC. Mr. Jon Carson and one of the property owners were present. The Commission members considered the following items: • That the variance, if granted, will not alter the essential character of the neighborhood; • That the granting of the variance will not be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located; The subject property is suitable for the proposed zoning classification. • That the proposed variance will not impair an adequate supply of light and air to adjacent property, substantially increase the danger of fire, otherwise endanger the public safety, or substantially diminish or impair property values within the neighborhood. • The Development Review Committee reviewed the proposed zoning amendment at their December 29, 2021 meeting and recommend approval. SUMMARY RECOMMENDATION: The Development Review Committee members reviewed the ordinance amendment at their February 2, 2022 meeting and recommended approval. It is anticipated the recommendation of the Planning and Zoning Commission would then go to City Council at their March 7th and March 15th meetings for consideration. BACKGROUND: Attached is a copy of a proposed amendment to the Development Ordinance in regards to fencing & landscaping on residential property adjacent to Lake Storey. The proposed ordinance will limit the height of fences to 4 feet and require them to be at least 40% open. New landscaping (shrubbery, ornamental grasses, evergreen trees, vines, hedges and the like) shall also not exceed 4 feet in height, with the exception of deciduous trees if they are planted at least 50 feet apart. This ordinance recognizes that Lake Storey possesses special recreational, community and aesthetic interests and values and places height limits for the purpose of preserving adequate natural light to promote public health in general. The proposed amendment will protect, enhance and perpetuate the unique views of Lake Storey available to property owner and visitors in a manner which is harmonious and maintains the character of the neighborhoods adjacent to Lake Storey. BACKGROUND: Attached for the Commission’s review is a zoning map amendment received from Klingner & Associates on behalf of the owner, KXZ Properties, LLC. The application requests a rezoning of a portion of property from R3A, Multi-Family to B3 Central Business District. KXZ Properties, LLC purchased the property in November 2021. The property has been vacant and underutilized since August 2013. The owner is proposing a phased renovation of the entire building which would result in business/office uses on the first and second floors, residential units on the 3rd through 5th floors and potential restaurant on the rooftop. The attached aerial shows the general location of the lot in question and the existing zoning.
