Approve Minutes of the February 15, 2022 meeting Member Lee moved to approve the minutes, seconded by Member Uhlmann. Minutes were approved by voice vote. Update Past Planning and Zoning Commission items • Zoning amendment to go from R3A, Multi-Family to B3 Central Business District for KXZ Properties, LLC, located at 239 S Cherry Street The City Council will consider this at their March 21, 2022 meeting. • Ordinance amendment regarding fencing & landscaping on residential properties adjacent to Lake Storey was recommended for denial by the Commission and the item was removed from consideration by the City Council. Receive Citizen Comment None Received. PZ-22-0301 Review Minor Plat of The Nielson East Subdivision), located at 547 N Farnham St. The petitioner was Community Unit School District #205 of Knox & Warren Counties. The applicant is communicating with utility companies and Ameren has requested a 10 foot utility easement ( 5 feet either side of the east and south property lines of proposed Lot 1) and a 10 foot utility easement for the primary servicing of the building. The Commission members considered the following items: • Adequate utilities, access roads, drainage and other necessary facilities will be provided; • Adequate measures will be taken to provide ingress and egress so designed as to minimize traffic congestion on the public streets. • The Development Review Committee reviewed the proposed variance at their March 2, 2022 meeting and recommended approval. BACKGROUND: Attached for the Commission’s review is a Special Use application submitted by Tyrone Johnson. Mr. Johnson is proposing to purchase the property and construct mini-storage buildings in a phased project. There was a fire on this property in the summer of 2009 and the building was demolished in 2010. The property has been vacant and underutilized since that time. The property is zoned B2, General Business. The B2 District provides for a wide range of businesses and services relying upon the patronage from areas beyond the immediate neighborhood in which they may be located. Zoning Land Use North B2, General Business Bank West B1, Neighborhood Business Gas station East R1A, Single Family Residential South R3A, Multi-Family Residential If the Special Use is approved, the development would not occur until site and landscape plans are submitted for review by the Development Review Committee and construction plans are submitted for review by the Inspection Division. Required setbacks on this property are: The north property line (fronting on Dayton St) would require a 20 foot front yard setback. (per Section 152.031 A) The east property line (fronting on Monroe St) would require a 20 foot front yard setback. (per Section 152.031 A) The west property line would require a zero foot setback, or if provided, it must be at least 5 feet. The landscape ordinance is only applicable to the east and south property lines that abut, or are across the right of way, from residential. • The south property line would require shrubs at least 6 feet in height (4 foot in the front yard setback). At least 50% of the shrubs shall be evergreen and all shrubs spaced at least 4 feet on center. As an alternative, a solid six foot high fence can be installed with at least one shade tree every 100 feet. • The east property line shall have shrubs across 100% of a parking lot (exclusive of driveways) at least 3 feet tall and spaced 4 feet on center. Except in the site visibility triangle where the height shall be kept to 2 ½ feet. Also, a mix of shade, ornamental and evergreen trees at least one every 100 feet. The Planning and Zoning Commission is authorized to grant special use permits and to hear and decide upon applications for special use permits listed in the district regulations of this chapter. Before authorizing the issuance of a special use permit, the Commission may impose any conditions that will, in the Commission’s judgment, ensure: (1) The proposed amendment is consistent with the intent of the Comprehensive Plan; (2) The establishment, maintenance or operation of the special use will not be detrimental to or endanger the public health, safety, morals, comfort or general welfare; (3) The special use will not be injurious to the use and enjoyments of adjacent properties for the purposes already permitted, nor substantially diminish and impair property values within the neighborhood; (4) The establishment of the special use will not impede the normal and orderly development and improvement of surrounding property for uses permitted in the district; (5) Adequate utilities, access roads, drainage and other necessary facilities will be provided; and (6) Adequate measures will be taken to provide ingress and egress so designed as to minimize traffic congestion on the public streets. (C) Transference. A special use permit shall not be transferred to another location; nor shall a special use permit be conveyed to another use at the same location. A new special use permit shall be required for either of these two changes. (D) Time limitations. The following time limitations shall apply to special use permits: (1) In cases where the use authorized by a special use permit requires a building permit, the applicant shall have three months from the date the special use permit is granted to apply for a building permit. If application has not been made within that time, the special use permit shall expire and become null and void; (2) In cases where a building permit is not required, any construction or activity authorized or required pursuant to the special use permit must commence within three months from the date the special use is granted. SUMMARY RECOMMENDATION: The Development Review Committee members reviewed the zoning amendement during their March 23, 2022 meeting and recommend approval. BACKGROUND: Attached for the Commission’s review is a zoning amendment. At their February 7, 2022 meeting the City Council approved the sale of a portion of HT Custer Park to the adjacent neighbor at 550 East Fifth St. The portion of the property that was sold is zoned Institutional (I) and it is proposed to amend the zoning to match the existing zoning of the property at 550 East Fifth St, which is R1B, Single Family.
