PLANNING AND ZONING COMMISSION MEETING
COUNCIL CHAMBERS OF GALESBURG CITY HALL

Tuesday, October 29, 2024 at 5:30 p.m.
MEMBERS PRESENT: Katina Cochrane, Bill Johnson, Ardennia Leahy, Carla Markwart, Steve
McKelvie, Neil Thomas, David Uhlmann, 7.
MEMBERS ABSENT: Mark Lee, Jason Paulsgrove, 2.

Chairman declared quorum present.
Approve Minutes of the October 22, 2024 meeting
Member McKelvie moved to approve the minutes, seconded by Member Leahy.
Minutes were approved by voice vote.
Update Past Planning and Zoning Commission items
• Minor Plat of the Fritzler Estates Extension Two, located in the 1900 block of East
Fremont St. P&Z recommended approval and this will go before City Council at their
November 4th meeting.

PZ-24-1002 Public Hearing Minor Plat of the Seminary Square Commercial
Resubdivision No 4, located at 503 Knox Sq Dr.
Mr. Tony McAndrew was present on behalf of the owner. Mr. McAndrew was sworn in by the
Chairperson.
Mr. McAndrew explained that there is a potential local buyer for the proposed Lot 3 (south portion of
the property). They do not have a current development in mind for proposed Lot 2, but chose to
subdivide in this manner for potential future development if an interested party comes forward.
The Commission members considered the following items:
• The subdivision is in compliance with the Development Ordinance.
• The Development Review Committee reviewed the Minor Plat at their October 22, 2024 meeting
and recommended approval conditioned upon responses that have since been submitted.
Member Thomas moved, seconded by Member Uhlmann to recommend approval of the Minor Plat.

AGENDA ITEM: PZ-24-1101 Zoning Amendment from I, Institutional to B3, Central Business
District for parcel identification number 99-15-206-001, commonly known as 40 E Simmons St.
SUMMARY RECOMMENDATION: The Development Review Committee members reviewed the
Zoning Amendment request during their November 6, 2024 meeting and recommend approval.
BACKGROUND: The applicant is planning to sell the property and would like to rezone to the B3,
Central Business District which allows for a variety of mixed uses that are appropriate for the
downtown area.
The purpose of the B3 District is to provide for a wide range of businesses and services typically
located in an urban downtown environment such as retail, residential, governmental, office,
cultural, hotel, entertainment and ancillary uses. This district also serves to maintain the
traditional business core of the city, and allow a mix of businesses, office, governmental and
residential uses to encourage social, cultural and civic functions.
The 2019 Comprehensive Plan indicates this area to be Downtown Mixed Use (which is B3).
It is anticipated this item will go to the City Council December 2nd on First reading and December
16th on Final reading.

Zoning Map Amendment approval criteria
152.017 ZONING MAP AMENDMENTS (REZONING)
(F) Map amendment approval criteria. Zoning map amendments may be approved if the City
Council reviews all of the following criteria:
(1) The proposed amendment is consistent with the intent of the Comprehensive Plan;
(2) The proposed amendment corrects an error or inconsistency or addresses some changing
condition in the area; if the change is inconsistent with the Comprehensive Plan and the
rezoning is approved, the Comprehensive Plan should be amended to reflect this change
in use;
(3) The proposed amendment will allow development that is compatible with existing uses
and zoning of nearby property;
(4) The city and other service providers will be able to provide adequate public facilities and
services to the subject property, while maintaining adequate levels of service to existing
development;
(5) The proposed amendment will not result in significant adverse impacts on other property
in the vicinity of the subject tract or on the environment, including air, water, noise,
stormwater management, wildlife and natural resources; and
(6) The subject property is suitable for the proposed zoning classification.

WHEREAS, pursuant to a public hearing duly held as required by law, the Planning and
Zoning Commission to the City of Galesburg, Illinois, has reported on a proposition to amend the
Zoning Map of said City as hereinafter set forth;
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GALESBURG,
ILLINOIS:
SECTION ONE: The following described real estate shall be, and the same hereby is, rezoned
from I, Institutional to B3, Central Business District:
Tract I:
Original Lots Three (3) and Four (4) in Block Thirty-two (32) in the Village, now City of Galesburg,
Knox County, Illinois.
Tract II:
The West Forty-Six and one-half ( 46 ½) feet of the North Eight rods of Lot Two (2) in Block Thirty-
two (32) in the City of Galesburg, Knox County, Illinois.
Tract III:
Beginning at a point, which point is in the Northeasterly Corner of Block Thirty-two (32) in the City
of Galesburg, at the intersection of the Southerly side of Simmons Street with the Westerly side of
Cherry Street; thence in a Westwardly direction along the Southerly side of Simmons Street a
distance of One Hundred Ten (110) feet to a point; thence in a Southwardly direction and parallel
with the Westerly side of Cherry Street a distance of One Hundred Thirty-five (135) feet to a point;
thence in an Eastwardly direction and parallel with the Southerly side of Simmons Street a distance
of One Hundred Ten (110) feet to a point in the Westerly side of Cherry Street; thence in a
Northwardly direction along the Westerly side of Cherry Street a distance of One Hundred Thirty-
five (135) feet to the point or place of beginning; being the North One Hundred and Thirty-five

SECTION 3 This ordinance shall be in full force and effect from and after its passage,

AGENDA ITEM: PZ-24-1102 Sign Variance for Extreme Car Wash, located at 1720 E Main St.
SUMMARY RECOMMENDATION: The Development Review Committee members reviewed the
variances during their November 6, 2024 meeting and recommend approval.
BACKGROUND: The owner is seeking to replace the current marquee sign with a digital sign of
the same dimensions. As the current pole sign is non-conforming, they are seeking the following
variances of Section 152.232 B1, B2, B3 and CPD Districts (A) On-premises free-standing (pole,
pylon, ground or monument) sign:
152.232 (A) (4) Pole and pylon signs shall have a maximum height of 20 feet. Monument and
ground signs shall have a maximum height of ten feet in any B2, B3 or CPD Zoning District, and a
maximum height of six feet in any B1 District.
• The current pole sign is 20 feet and 3 inches in height.
152.232 (A) (6) Minimum setback from the property line of ten feet.
• The current marquee sign (as part of the pole sign) is setback 3 feet and 1 inch from the
property line.

152.191 Appeals and Variances. (Signs)
(A) Appeals. Hear and decide appeals by the sign permit applicant where it is alleged there is an error
in any order, requirement, decision or determination made by the Building Inspector in the
enforcement of this subchapter;
(B) Variances. Grant variances from the requirements of this subchapter and §§ 152.205 through
152.220 or 152.230 through 152.233 where the Building Inspector has denied granting a sign permit
as a result of noncompliance with the requirements of these subchapters.
(C) Criteria for decision. The Planning and Zoning Commission shall have the power to grant a variance
from the provisions or requirements of this subchapter only where the following criteria have been
considered:
(1) The literal interpretation and strict application of the provisions and requirements of this
subchapter would cause undue and unnecessary hardship to the sign user because of unique or
unusual conditions pertaining to the specific building or property in question;
(2) The granting of the requested variance would not be detrimental to or endanger the public health,
safety, morals, comfort or general welfare;
(3) The granting of the variance would not be injurious to the use and enjoyment of other property
in the immediate vicinity, nor substantially diminish or impair property values within the adjacent
area;
(4) The unusual conditions applying to the specific property do not apply generally to other buildings
or properties in the city; and
(5) The granting of the variance will not be contrary to the general objectives set forth in § 152.019.
(D) Determination of conditions. In granting a variance, the Commission may impose any conditions
regarding the location, character or other features of the proposed sign as it may deem necessary
to carry out the purpose and intent of this subchapter and §§ 152.205 through 152.220 or 152.230
through 152.233.
